Romania To Amend Clawback Tax

Romania”s Health Minister said the legislation regarding the clawback tax will be changed to allow a different calculation for generic drugs and original brand-name drugs.

Speaking at a conference organized by Ziarul Financiar, Nicolaescu said the clawback tax will be applied differently for generic and brand-name drugs to create a fair system and provide a wider range of generic drugs at low prices.

The minister said the tax on generic drugs is higher than that on other categories of medicines. The tax will be calculated based on the revenues obtained by pharmaceutical companies from the sale of compensated drugs.

The clawback system was implemented at the end of 2009 and stated all medicine producers must contribute 5% to 11% of drug sales to finance the public healthcare system.
